AAM Files Suit In Illinois To Block ‘Overreaching’ Price Gouging Law

House Bill Described As Counterproductive, Will Lead To Fewer Generics

The AAM is taking legal action against the Illinois attorney general over a recently established state bill that aims to halt price spiking for generic drugs in the state, following successful challenge in other states.

After preliminary success taking down a similar pricing law in Minnesota late last year, the US Association for Accessible Medicines has filed a lawsuit in Illinois seeking to enjoin the state’s attorney general Kwame Raoul from enforcing the price-control provisions of local House Bill 3957.

“The Illinois law, an unconstitutional overreach signed into law in July 2023 and taking effect [last month], grants Illinois sweeping powers to regulate the national pharmaceutical market, violating the US Constitution and posing harm to vulnerable patient communities,” according to the lawsuit
