Two device company executives convicted of charges related to off-label promotion won’t see prison time, a Massachusetts federal judge ruled last week.
Former Acclarent CEO William Facteau and former VP of sales Patrick Fabian were convicted in July 2016 on ten counts of misdemeanor adulteration and misbranding for their roles in the company’s marketing of its Relieva Stratus sinus dilation device, but immediately appealed. In September, Judge Allison Burroughs of the US District Court for the District of Massachusetts denied requests for acquittal or a new trial, allowing the case to move to the sentencing phase
