Is A Pharma Sales Rep A Salesman? Supreme Court To Make Final Call

Court to decide whether sales reps qualify for overtime pay in case involving former GlaxoSmithKline reps; it is the third pharma case this term.

Pharmaceutical companies and sales representatives will finally get a national rule on whether reps qualify for overtime pay as the Supreme Court agreed to hear a case involving former GlaxoSmithKline PLC reps.

The issue has created a great deal of uncertainty for both sides as courts have issued different rulings as to whether pharma sales reps are outside sales employees, a category exempt from overtime pay under the Fair Labor Standards Act
