FTC Members Spar Over ‘Protected’ Speech On ‘Dr. Oz’ In Supplement Claims Enforcement

FTC announces a settlement including $9 million in consumer redress for false ads for green coffee extract supplements. The Federal Trade Commission’s latest order requiring clinical trials to support dietary supplement claims reveals a schism among commission members over whether health claims and other promotional comments made on “The Dr. Oz Show” and other TV programs are commercial speech.
