ICMAD Clutches To House Cosmetics Bill Before Specter Of ‘Activist FDA’

Locke Lord attorney Sharon Blinkoff, general counsel for the small-business trade group, says the newly introduced Safe Cosmetics Modernization Act is crafted to update cosmetics regulations without making room for oppressive oversight or a revival of the aggressively conservative FDA of decades past.

There are aspects of the proposed Safe Cosmetics Modernization Act, introduced in the House Jan. 13, that are bound to be contentious. To understand their etiology one must go back in time to the dawning of cosmeceuticals and the regime of a more aggressive FDA than the cosmetics industry knows today.

The Washington Department of Ecology hasn’t backed down on its targeting of formaldehyde-releasing preservatives under the state’s Toxic-Free Cosmetics Act, as industry still awaits a draft final rule. In a recent webinar, attorney Angela Deisch of Amin Wasserman Gurnani, LLP said the department has also not provided clarity on penalties under the law, which goes into effect 1 January.
