Four months into session, no bills have been introduced in Congress to authorize FDA to establish a regulatory pathway for the lawful use of hemp ingredients in products other than drugs or propose some other solution to the federal conundrum present since lawmakers in 2018 de-scheduled hemp.
“We've heard perhaps some kind of support for non-drug approaches to addressing a range of conditions,” says food and drug regulation attorney Jessica O’Connell. “For the first time in the nearly 80 years of HHS, we will have a secretary who actually sees our commodity is valuable and not just some nuisance they have to deal with,” says NPA CEO Daneil Fabricant.
“I think the Republican Congress is going to slow down all of what's called progress, for lack of a better word, toward having hemp be accessible to folks in all kinds of forms,” says Doug Gansler, former Maryland state AG and chair of Cadwalader, Wickersham & Taft LLP’s state AG practice.
