Medicare Price ‘Negotiation’ : Manufacturer Compliance Gets Tougher Enforcement Provision

As legislation authorizing Medicare price 'negotiation' clears the Senate and appears on its way toward enactment after years of efforts by US congressional Democrats, and opposition by Republicans and the pharmaceutical industry, the bill continues to be tweaked.

Manufacturers who choose not to comply with the Medicare price negotiation process for one of their drugs either face an up to 95% excise tax on the drug’s revenues or the prospect that none of their drugs will be covered by Medicare or Medicaid, under landmark drug pricing legislation approved by the US Senate on 7 August.

The change is among a handful of revisions made to the bill over the past few weeks
