France’s attempt to effectively ban the sale of hemp-derived cannabidiol is contrary to European Union Law, according to an advocate general of the region’s highest court, whose opinion is likely to have far-reaching ramifications for Europe’s CBD market.

With French legislation restricting the cultivation, importation, exportation and industrial and commercial use of hemp solely to its fibre and seeds, a court is seeking to criminally prosecute the marketers of an e-cigarette containing CBD oil extracted from the whole hemp plant
