Plaintiffs’ Bar Is Ignoring Your ‘Free Of’ Claims Guidance – Cleaning Products Industry To FTC

In addition to expanded guidance on “free of” claims, the American Cleaning Institute seeks additional guidance on claims related to compostability, degradability, recyclability and recycled content. Comments to the US FTC on proposed revisions to the agency’s “Green Guides” were due on 24 April.

Class action plaintiffs are ignoring the US Federal Trade Commission’s Guides for the Use of Environmental Marketing Claims (“Green Guides”) with regard to “free of” claims, the American Cleaning Institute suggests in 24 April comments to the agency.

“Marketers who are in compliance with the Green Guides may still find themselves subject to a class action lawsuit alleging that a product advertised as ‘free of’ is deceptively advertised because it contains trace amounts of the substance,”
