Proposition 65 titanium dioxide lawsuits have been halted by a ruling in California in a First Amendment case, which could bode favorably for other scientific challenges to mandated warning labels.

Marketers of blush, eyeshadow, and other cosmetic products have been the main target of Prop 65 notices and lawsuits related to titanium dioxide.

A California court has determined that required Proposition 65 cancer warnings on cosmetic product labels for a specific form of titanium dioxide are likely misleading, delivering a “major win for the cosmetics industry,” per attorneys in the case.
