Following the principle that a generics firm should “clear the way” and resolve issues of patent validity and infringement ahead of launch, Teva has been denied a request to stay or strike out UK infringement claims brought by Chiesi over its Fostair respiratory brand.

Teva has failed to secure a stay of infringement claims brought against it by Chiesi in UK litigation over the originator’s Fostair (beclomethasone/formoterol) respiratory brand.
