The US House, a week after the Food and Drug Administration published guidance on voluntary labeling of sesame as an allergen, passed legislation expanding the agency’s research into sesame and other food allergens and broadening its authority for requiring related label changes.

Food Allergy Safety, Treatment, Education, and Research Act would amend FDA regulations to include sesame as major allergen and allow agency to add other food ingredients as major allergens based on prevalence and severity of allergic reactions. FDA, meanwhile, published guidance for voluntarily labeling sesame as an allergen while it develop its factors for evaluating which food allergens in addition to the eight already specified in its regulations should be designated as requiring additional controls, including allergen labeling.

Eliminating self-affirmation process would require companies to publicly notify FDA of their intended use of ingredients and provide safety data before they’re introduced. Kennedy says the process is “a loophole” for introducing ingredients and chemicals “with unknown safety data.”
