Cosmetics Reform In, Dietary Supplements Out Of US Omnibus Spending Bill

The must-pass federal spending bill includes the Modernization of Cosmetics Regulation Act, which previously appeared as a rider in US Food and Drug Administration user-fee legislation but was cut from the final iteration.

Provisions that would overhaul the US Food and Drug Administration’s oversight of the cosmetics industry have made the cut in an omnibus bill to fund the government in 2023, moving the long-awaited reforms tantalizingly close to the finish line.

Released 20 December, the Consolidated Appropriations Act of 2023 is a massive, sprawling spending bill that directs $1.7 trillion in fiscal dollars for next year

The Washington Department of Ecology hasn’t backed down on its targeting of formaldehyde-releasing preservatives under the state’s Toxic-Free Cosmetics Act, as industry still awaits a draft final rule. In a recent webinar, attorney Angela Deisch of Amin Wasserman Gurnani, LLP said the department has also not provided clarity on penalties under the law, which goes into effect 1 January.
