If not for flawed testing results that overestimated the health risks posed by sound abatement foam in many of its sleep apnea devices, Philips Respironics would have pursued a more targeted and focused recall, according to a recent complaint the company filed in the US District Court for the Western District of Pennsylvania.

Philips has filed a lawsuit against a Pennsylvania lab it hired to analyze sound abatement foam that prompted widespread recalls of its CPAP machines. Philips alleges PSN Labs grossly overestimated the risk to patients, which led Philips to initiate a larger recall than it otherwise would have.
