The pharmaceutical industry has been distressed by the government's efforts to hold individuals criminally liable for violations of the Food, Drug, and Cosmetic Act. So the case of two executives sentenced to three-month prison terms for introducing salmonella-contaminated eggs into interstate commerce grabbed its attention.

The Pharmaceutical Research and Manufacturers of America filed an amicus brief with the US Chamber of Commerce asking the U.S. Court of Appeals for the Eighth Circuit to reverse the sentence
