Unlike the vetoed California bill, similar legislation introduced and remaining active in Massachusetts, Missouri, New Jersey, New York and Rhode Island also would affect sales of bodybuilding supplements.

In Massachusetts during the second year of the legislature’s two-year session in 2022, H 4271 has been favorably reported by the House Public Health Committee and recommended for passage by the Health Financing Committee, with the Senate’s concurrence, before being sent in June to the House Ways and Means Committee before the session ended in August. The bill is a replacement for similar House and Senate bills which had been introduced in 2021.

In Missouri, SB 922 was introduced early in the 2022 session, which adjourned its regular schedule on 21 September and its extra session on 4 October, proposing to prohibit sales of OTC pills and supplements for weight loss or muscle building to consumers under 18. The bill didn’t move out of the Insurance and Banking Committee after being referred there in February.

Sales of weight loss and bodybuilding supplements in New Jersey would be age-restricted under bills introduced again this year, the first of a two-year session, in the Assembly, A 3512, and the Senate, S 2387; neither bill has moved out of committee while the legislature remains in session.

Legislation was introduced in both New York legislative chambers in 2021 and passed the Senate earlier in 2022 before the Assembly rejected it and sent it back to the Senate, which again passed the legislation and sent it to the Assembly in March. No movement on the bill – A 431C and S 16D – happened before the session adjourned in June, according to the state’s legislative records.

The Rhode Island Senate before the legislative session ended in June passed a bill, S2613, to prohibit sales to minors of weight loss and bodybuilding supplements. The bill, sent in the House Health and Human Services Committee, identifies ingredients which would violate the prohibition as an ephedrine group alkaloid and androstanedoil, androstenedione, androstenedione, noradrostenediol, norandrostenedione and dehydroepiandrosterone.
