Hain Celestial ‘Natural’ Case Could Set Precedent Favorable To Industry

Hain Celestial is not out of the woods regarding the truthfulness of its JASON natural claims, with a California appellate court reversing a lower court’s 2012 dismissal of a false-advertising class action against the firm. However, the appeals court agrees that FDA should have primary jurisdiction over natural cosmetics claims, which could result in the Hain case being stayed until the agency gets around to defining “natural” as it applies to cosmetics.

A class action alleging misleading “natural” claims for Hain Celestial Group’s JASON personal-care products may proceed in California district court, following an appellate court’s April 10 reversal of the lower court’s dismissal of the case.
